FGEIs (C/G) Dte Rawalpindi has issued the Revised Promotion List of FGEIs teachers under the Four Tier Formula vide Notification No. 0409/8/2012-FGEI (M) dated 22nd March 2013.

There are promotion of teachers to Assistant Headmasters (BPS-17), Headmasters (BPS-18, 19 and 20). In connection with the Dte letter of even number dated 30th January 2013 revised promotion orders are issued in pursuance of Judgment of Lahore High Court Rawalpindi Bench, Rawalpindi. Notification of Promotion of Teachers from BPS-18 to 19 of Punjab Education

Punjab School Education Department has issued the Notification of the Promotion of Officers/Teachers (Male) General Cadre with immediate effect. Notification No. SO (S-VI) 6-8/2012 dated 15th April 2013 has been issued in this regard.

Consequent upon the approval of the recommendations made by the Provincial Selection Board-II in its meeting held on 05-03-2013 officers/teachers of BPS-18 (General Cadre-Male) of School Education Department have been promoted to BPS-19 on regular basis with immediate effect. However their posting/adjustments orders shall be issued separately, within due course of time.

If any officer fails to join his new assignment within 15 days after issuance of his posting orders separately, he shall be deems to have forgone his promotion. The effect of forging of promotion entails suspension as clarified in promotion policy 2010 notified by the Government vide No. SOR-II (S& GAD) 2-134/2010 dated 11-08-2010. Award of Time Scale to the Non-Teaching Cadre(s) Posts Under Federal Directorate of Education

Govt of Pakistan Ministry of Capital Administration and Development, Islamabad has issued Orders No. F.1-1/11-(Admn) FDE dated 25th March 2013 regarding the Award of Time Scale to the Non-Teaching Staff working under FDE.

In response to a summary submitted to Prime Minister’s Secretariat, Islamabad seeking approval of the Honourable PM for award of Time Scale Promotion to the non-teaching cadre (s) under federal Directorate of Education, Islamabad on the basis of length of service.

The Honourable Prime Minister has been pleased to approve the award of promotion through time scale to posts of non-teaching cadres of BPS-01 to 15 under FDE, Islamabad on the basis of length of service.

FDE, Islamabad is therefore requested to prepare the promotion cases of all non-teaching cadres and place the same before the concerned Departmental Promotion Committee in line with approval of Prime Minister, accordingly. This special post is delivered by Jagdesh Kumar.

Notification of Pre-Mature Increment to All the Upgraded Employees since 28-01-2002

Finance Division Regulation Wing Islamabad has issued Notification No. 11 (4) R-2/2011-1153/2013 dated 31st May 2013 in connection with the grant of Pre-Mature Increment on the up-gradation of the employees.

This decision has been made wef 28th January 2013 and all the employees who have been upgraded wef the same date are eligible to get the premature increment on their up-gradation of posts. As the Govt has not allotted the amount for the expenses of the same case in the financial year 2012-13 so the same amount will be allotted in the next budget 2013-14 to meet the expenses for the said cases.

Various appeals were submitted in the Federal Service Tribunal for the said purpose and the notification has been issued in consequence of these appeals. As the Supreme Court of Pakistan made a decision on 28-01-2002 so the benefit of the premature increment will also be applicable with effect from the same date.

Lahore High Court, Rawalpindi Bench, Rawalpindi has given its decision on 03-06-2013 in favour of the FGEIs teachers in connection with up gradation and Time Scale Promotion.

It is added that the teachers of Federal Directorate of Education are already enjoying the Up-gradation and Time Scale Promotion Scheme. The summary of this decision is that:

In view of the Prime Minister’s Directions No. 2605 dated 17-02-2011 and keeping in view the order dated 29-09-2008 passed by the Federal Service Tribunal and the judgment dated 13-02-2012 passed in W.P No. 1826/2011, there are no reasons to form a different opinion than the one formed in the referred judgments. These writ petitioners are accepted. The respondents are directed to make the funds available and order the up gradation in the case of the petitioners which has so far been withheld on the pretext of the paucity of the funds wef 01-01-2011 the date when the same up gradation bestowed to those serving under the FDE, Islamabad keeping in view the time scale formula in case of the petitioners in the instant W.P No. 1622/2012 and to the other petitioners without the application of the time scale formula as it is not applicable in their case.

Byname Notification of Upgradation of FGEIs Accountants from BPS-11 to 14

FGEIs (C/G) Directorate Rawalpindi has issued Notification No. 0409/6/77-FGEI (NTS) dated 26th June 2013 in connection with the upgradation of all FGEIs (Cantt/Garrison) Accountants workings in various offices/institutions. These Accountants have been upgraded wef 30-10-2012 from BPS-11 to BPS-14.

It is to explain that the Finance Division Regulation Wing, Islamabad has already upgraded the Accountants vide Notification No. F.1 (3) R-I/2010-67 dated 30th October 2012 but the case of amendment in recruitment rules was in process and after the completion of the same process this notification has been issued.

It is to clarify that all the clerical posts were upgraded wef 01-07-2007 but the posts of Accountants were remained untouched since long. To get their rights the Accountants of FGEIs (C/G) knocked the door of Federal Service Tribunal and the FST gave its decision of these accountants. In pursuance of the decision of FST, Finance Davison also issued its notification but with immediate effect instead of 01-07-2007.  Hope this up-gradation will be soon effective wef 01-07-2007.

Grant of BPS-17 to Baluchistan Schools SSTs & Option to Pix Pay after Annual Increment

Govt of Baluchistan Finance Department has issued Notification No. FD (R-I) III (40-41) 2013/2857-2887 dated 25th June 2013 in connection with the fixation of pay of the SSTs upgraded from BPS-16 to BPS-17, after annual increment 2012.  These SSTs were upgraded wef 01-07-2012 and in this case the service of 6 months is not completed so they were not entitled to get the annual increment of 2012.

In this notification it has been granted authority for all these SSTs (Secondary School Teachers) to retain their in BPS-16 upto 01-12-2012 to avoid the loss of one increment.

After availing the annual increment in BPS-16 on 01-12-2012, they are allowed to fix their pay in BPS-17 on 02-12-2012. If the Govt of Baluchistan Finance Department also issues the Notification of Premature Increment on up-gradation, then these teachers will also be eligible to get the premature increment on their up-gradation. The same notification has already been issued by the Finance Division Regulation Wing Islamabad for the Federal Govt Employees.

Summary of 15% Increase in Salaries & Regularization of Contract Employees of Punjab

According to the Daily Pakistan dated 17-08-2013 the summary of 15% increase in salaries for the Punjab Govt employees as well as the regularization of contract employees has been submitted to the Chief Minister Punjab for approval.

According to the news Chief Secretary Punjab has submitted the summary of regularization of contract employees, 15% increase in salaries, up-gradation of the employees and other demands by the APCA to the CP Punjab.

It is to mention here that the CM Punjab has already announced the regularization of contract employees before the Election 2013 and the notification of the same was issued but due to the orders of the Election Commission the implementation on the same was postponed and now it is a big news for the employees if the CP Punjab approves the same.

The summary of the orders is that it is stated in these orders that “ In accordance with the dictum of the provision of constitution the case of Auranzeb (1977 PLC CS 767), the complainants are entitled to the up-gradation of their posts on the analogy of Lahore High Court order dated 10-08-2012. Non grant of higher BPS to the complainants on the anology of orders dated 10-08-2012 would amount to maladministration within the meanings of Section 2(2) of the Punjab O/o Ombudsman Act 1997, established in the CMIT. The departmental authorities of the complainants are directed to prepare case of up-gradation of posts and send the Finance Department with their recommendations and report compliance to this office within three months as required under Section 11(2) of the act ibid.

Modification in Date of Up-gradation of Junior Accountant in Pakistan Post

Junior Accountants in Pakistan Post were upgraded from BPS-12 to BPS-16 wef 19-07-2011 vide Notification No. Even dated 21-07-2011. Now the up-gradation of these Junior Accountants has been granted wef 12-09-2005 vide the Director General Pakistan Post Islamabad Notification No. Estt.2-7/2007 (KW) (Pt) dated 2nd September 2013.

It is a ponder able point that the Accountants in various departments of Pakistan are working in various pay scales. In FGEIs (C/G) the post of Accountant was upgraded to  BPS-14 while the post of Junior Accountant in Pakistan Post is of BPS-16. It means that Junior Accountant has the BPS-16 while a full fledged Senior Accountant has BPS-14. This is a clear discrimination with the Accountants of various departments. The Government should think over this point and should give the equal rights for all the employees.

Provision of Documents Regarding Promotion of SSTs as SS

The Director (Admn-Male) for Director Public Instruction (SE) Punjab Lahore has submitted a circular No. 7472/AD(C-I) dated 11th September 2013 to all the District Education Officers, Punjab (SE) to provide the following information/documents of each SST for promotion as SS within the targeted date i.e 25-09-2013. After this date no case of promotion will be considered and the concerned SST as well as the DEO will be held responsible in this regard and no excuse will be accepted. The detail is shown in the picture/circular in connection with the subject case.

All the SSTs may be directed to provide their complete data on the prescribed promotion proforma duly countersigned by the concerned Head of the Institution as well as DEO (SE), concerned.

At the time of preparation of working paper, the cases out of the above will be considered as per availability of posts and issuance of this letter will not be claimed as a right of promotion. The full detail on this matter is shown in the letter.

According to the daily express Rahim Yar Khan dated 10th October 2013, the Punjab Mohtsib has again ordered the Finance Department, Govt of Punjab to up-grade the clerical posts with immediate effect in the Punjab Government Departments and to submit a report upto 29th October 2013 in this regard.

Punjab Mohtsib has already issued orders for the upgradation of clerical staff wef 1st August 2008 in Punjab Govt Departments. The detail of this up-gradation is as under:

Premature Increment to SSTs Appointed Against 50 % in Service Quota

Government of the Punjab Finance Department already issued a Notification No.FD.PC-40-6-2007 dated 25th April 2009 in connection with the benefit of premature increment/ re-fixation of pay to serving SSTs appointed against the 50 % in service quota. I will express the matter with detail regarding Premature Increment to SSTs and also the same to ESTs. 

The said matter was examined in pursuance orders of the Honorable Lahore High Court, Lahore dated 09.04.2008 in subject writ petition.

2.   As  per  method  of  recruitment  originally  prescribed  in  the  Punjab Education  Department  ( School  Education ) recruitment  rules ,1987, the  post of secondary school teacher was required to be filled in 100% by initial recruitment subsequently, amendment was  made  in the service rules on 27.07.1991 according to which the post of SST was to be filled in as under:

“By initial recruitment, provided that 50 % post shall be filled from amongst   in service teachers possessing   prescribed   qualifications

For initial recruitment for the post of secondary school teacher”

3-  The   above  service  rules  were  further  amended  on  25-05-1983 according to which the post of SST was to be filled in as under:

(a)  50 %  of  the  post  shall  be  filled  in by initial recruitment  provided Further that:

(i)   75% from amongst the science graduates for appointment in the subjects of Mathematics, Science & Biology.

(ii)    25% from amongst graduates in Arts subjects.

(b)   50 %  posts  shall  be  filled  amongst  in service  teachers  possessing Prescribed qualifications   for   initial   recruitment   for  the  post of secondary school teacher provided that:

(i)    85  %  of  the   posts  shall  be   allocated  for  teachers  in  Arts subjects.

(ii)   15 % of the posts shall be allocated for teacher of Mathematics, Science & Biology, if none is available then from the in teacher in Arts subjects.                  4-  The rule ibid were further amended on 24.12.2008 according to which the post Secondary School Teacher is to be filled as under:-

(i)    50% of the post shall be filled in by initial recruitment provided further that:

(a)   75 % from amongst the science graduates (having the B.Sc qualification   with   three elective   subjects out of   (A) Mathematics (B) Physics, Chemistry, Botany, &Zoology.

(b)  25% from amongst graduates in Arts subjects.

(ii)   50  %  posts   shall  b e filled  in   by   promotion   from  amongst Elementary School Teacher (General, Technical, Agri, vernacular Arabic  Oriental,  Drawing,  Physical  Education, English) having prescribed  qualification  as  mentioned  in  column  No.  6 on the basis of  length of service  from the date of regular appointment in the respective District provided further that:-

(i)   75 % posts shall be allocated for teacher in Arts subject. 25  %  of  the  posts  shall  be allocated  Science Graduates (having  the  B.Sc qualification with three elective subjects out of (A) Mathematics (B) Physics, Chemistry, Botany, &Zoology.

5-  It  has been decided that the benefit of premature increment/ re-fixation of pay  may  be extended only those serving Secondary  School  Teachers appointed against the 50 %  in service quota from the date of appointment as Secondary School Teachers  whose  cases are at par with Mr Zaka Ullah and they were appointed on or after 27.07.1991,the date when service rules were amended .

Clarification Regarding Premature Increment on Upgradation

Govt of Pakistan Finance Division Regulation Wing has issued Notification No. F.No.11 (4) R-2/2013-1427 dated 22nd October 2013 regarding the clarification about the Premature Increment on Upgradation. The queries arisen by various Departments/Divisions/Departments/Organizations etc were examined in connection with the premature increment on upgradation. The clarification of the same is as under:

1 Whether the employees of BPS-01 to 04 who were moved one scale up wef 01-07-2007 without upgrading their posts are eligible for one premature increment under O.M F.No.11 (4) R-2/2011-1153 dated/2013 dated 31-05-2013. No. Finance Division’s O.M dated 31-05-2013 provides for grant of premature increment on upgradation and not on move up.
2 Whether the employees who were holding Selection Grade prior to up-gradation of their posts in BPS already held by them are also eligible to the benefit of premature increment on up-gradation of their posts. Yes. Just as in same scale promotion.
3 Whether the employees who were holding Selection Grade and were drawing pay at the maximum of their pay scales in which their posts had been upgraded are entitled to one premature increment as personal pay beyond the maximum of pay scales or otherwise. Since the annual increment beyond the scope of pay scales was first time allowed wef 01-12-2005 in BPS-2005, therefore the employees who were at the maximum of their pay scales in which their posts have been upgraded are entitled to get one premature increment as personal pay as is granted to same scale promotion wef 01-12-2005.
4 Whether the employees who have been upgraded or granted one scale move up on or after 2nd June of a calendar year can opt for re-fixation of their pay on 1st December of that calendar year in the light of Finance Division O.M No. F.3 (2) GAZ.IMP.I/75 dated 14-10-1975. Yes
5 Whether premature increment will be granted to inspectors of FBR who were upgraded twice 1st in 2008 and 2nd in January 2013 from BPS-11 to BPS-14 and BPS-14 to BPS-16 respectively. Yes
6 Whether premature increment is admissible on upgradation of contractual staff employed on standard terms and conditions of contract or otherwise. Contract Employees who have been appointed in a BPS on standard terms and conditions of contract appointment if upgraded along with post are entitled to get one premature increment as in case of regular employees.
7 a- Whether the Private Secretary/Stenographer (re-designated as APS), Steno Typist, who have been upgraded Vide O.M No. 19 (55) Legal-II/2010-1055 dated 23-12-2011, are entitled for premature increment on upgradation. a- Premature Increment is admissible in case of Steno Typists, Stenographers, only whose posts have been upgraded. The post of Private Secretary has not been upgraded rather they have been granted time scale on completion of prescribed length of service, therefore they have not been allowed premature increment.
b- If yes, what would be the criteria of admissibility of grant of premature increment and arrears on up gradation? b- Whether the stage in BPS of higher (upgraded) post next above the pay admissible in BPS of lower (pre-upgraded post), gives the increment in pay equal to or less than a full increment of higher post will be fixed after allowing a premature increment in BPS of higher post.

The appellants possess the similar qualifications, nature of the duties performed are similar, work under the same roof and same officer. Similarly placed are to be treated similarly. No doubt the Punjab Govt works independently under the constitution but generally it follows the pay scales sanctioned by the Federal Govt.If two different pay scales are given to the Federal Govt Employees and the Provincial Govt Employees it may amount to extracting labour and exploitation under Article-3 of the Constitution of Islamic Republic of Pakistan. I tend to agree with the judgment of Lahore High Court 2004 PLC (CS) 586 that it is violation of the Article 2-A, 3, 25, 37 and 38 of the Constitution of Islamic Republic of Pakistan, 1973.

As far as the other two contentions of the respondents that the service structure will be affected and Govt of the Punjab will have to bear extra financial burden of Rs. 46.44 million, suffice to say that the service structure and financial constrains cannot stand in the way of Constitution. According to the chart placed on record by the appellants, respondent Provincial Govt will have to bear extra burden of Rs. 209,370/- whereas as per calculation of the respondent Finance Department the financial impact would be Rs. 46.44 million. This tribunal has no expertise in accounts that is not a big loss for the Provincial Govt. The law has to prevail. The up-gradations have already been made in Education Department, Police Department,, Excise & Taxation Department, Jail Department etc, there seems no reason that up-gradation should not be granted to the appellants.

In view of the above matter, all the appeals are accepted; impugned order dated 26-07-2012 is set aside. The appellants are declared to be entitled BPS-16.The Secretary Finance Department Punjab is directed to pass necessary orders in the light of the observations made above in order to remove the disparity/discrimination.

Govt of the Punjab Special Education Department Lahore has issued Notification No. SO(Estt)11-2/2009 dated 30th December 2013 in connection with the promotion of Junior Special Education Teachers (Mentally Challenged Field) BPS-16 to the rank of Senior Special Education Teachers (Mentally Challenged Field) BPS-17 on regular basis with immediate effect.

Uopn their promotion they have been transferred and posted in various institutions. These promoted teachers are hereby directed to join their new place of posting within fifteen days; otherwise it will be presumed that they want to forgo their promotion.
